Terms and Conditions for Editing.Church

Welcome to editing.church.

By using our services, you agree to comply with and be bound by the following terms and conditions. Please read them carefully.

1. Services Offered

editing.church provides professional video editing services tailored to the needs of churches and related organizations. Specific details regarding our packages, including pricing and deliverables, can be found on our website.

2. Subcontracting

editing.church reserves the right to subcontract services to qualified third-party professionals. This does not affect your rights or the quality of service you receive.

3. Payment Terms

Payments for services provided by editing.church are due upon receipt of the invoice. Outstanding balances must be paid within 7 business days. We accept various payment methods, including Stripe and Paypal, Stripe will automatically attempt to charge the outstanding balance a total of nine times (the initial charge plus eight additional attempts) in the event of payment failure. Clients will be notified of any unsuccessful attempts. If payment is not received after these attempts, editing.church reserves the right to suspend or terminate services until the balance is fully settled.

4. Cancellation Policy

Either party may cancel the contract with written notice. In the event of cancellation, any outstanding balances must be settled promptly.

5. Intellectual Property and Project Ownership

editing.church retains full ownership of all project files, including but not limited to video editing files, graphics, and any other editing materials created during the course of the project. These files will not be shared with any outside person or entity unless explicitly authorized by editing.church. Additionally, project files and editing materials will not be released to the client if there are any outstanding payments due. Full payment is required before any transfer or release of project files. If the client provides a project file for editing, they authorize editing.church to retain full control over that file once work begins. editing.church assumes ownership of the file after receiving it and has the right to use it as necessary for the completion of the project. The client retains a copy of the original project file but acknowledges that once editing.church begins working on the project file, it becomes the property of editing.church. The client’s provided project file will be used solely for the agreed-upon project unless further permissions are given by editing.church.

6. Confidentiality and Client Material Usage

As part of our agreement, you grant editing.church the right to use any materials you provide, including your church logo and any video or audio recordings, for promotional and marketing purposes. This includes showcasing our work on social media, websites, and other marketing channels to demonstrate our services. However, editing.church will never use your logo or materials in any way that represents your church, and all content will be handled with respect to your church's mission and values.

7. Creative Vision and Revision Policy

editing.church is committed to delivering the best possible version of your project within the scope of the agreed-upon revisions. However, creative differences may arise during the process. The client acknowledges that:

editing.church will work diligently to meet the client’s vision, but perfect alignment on every creative element may not always be possible.

The client is entitled to a set number of revisions per week, as outlined in the project agreement or package selected.

Additional revisions beyond the allotted amount may incur additional charges, which will be communicated prior to proceeding with further work. These additional revisions must be paid for in full before the work on them begins.

Final delivery of the project may reflect creative compromises, which are made in good faith to align the project vision with editing.church’s professional expertise.

8. Limitation of Liability

editing.church 's liability for any claim arising out of this agreement shall be limited to the total amount paid by the client for the services rendered. We are not responsible for any indirect or consequential damages. Any and all copyright claims, strikes, or disputes related to video projects provided by editing.church shall be the sole responsibility of the client. editing.church holds no liability for any copyright infringement, including but not limited to any issues arising from the use of third-party music, video content, or logos provided by the client. The client agrees to indemnify and hold editing.church harmless from any such claims, demands, or legal actions related to the content provided for editing.

9. Governing Law

These terms and conditions shall be governed by and construed in accordance with the laws of the United States and the State of Nevada. Any legal action or proceeding relating to this agreement will be brought exclusively in the state or federal courts located in Las Vegas, Nevada.

10. No Refund Policy

10.1 General No Refund Policy:

Once work on your project has commenced, all payments are non-refundable. By engaging

editing.church

to begin work, you acknowledge and agree that refunds will not be issued, even if the project is canceled or paused for any reason after work has started.

10.2 Yearly Subscriptions:

If canceled before the contract year ends, no refunds or prorated amounts will be provided.

editing.church will continue to work on your projects until the contract year has ended, but your subscription will not be automatically renewed.

10.3 Monthly Subscriptions

If canceled, no refunds or prorated amounts will be provided for the remaining time in the current billing cycle. editing.church will continue work until the end of that month, and your subscription will not be automatically renewed for the following month.

10.4 Custom Video Projects

Once the project scope and pricing are agreed upon and work has started, no refunds will be issued. Any changes requested after the project has begun may be subject to additional charges, and full payment is required for the release of final deliverables.

For custom video projects that require an upfront deposit, the deposit is 100% non-refundable , regardless of any changes or cancellation of the project. By making the deposit, the client acknowledges and agrees that the deposit will not be refunded under any circumstances.

10.5 Fraudulent Refund Claims and Chargebacks

Any attempt to initiate a fraudulent refund or chargeback through payment processors such as Stripe or PayPal, or any disputes to the client’s credit or debit card or bank account, will be vigorously contested. editing.church will provide all necessary documentation and proof of services rendered to dispute the claim. If a fraudulent refund is pursued, or if a chargeback or dispute is filed against editing.church's charges, we reserve the right to terminate all current and future services immediately. In the event of termination under this provision,

no refunds will be given, including any deposits or partial payments made toward the services. Additionally, legal action may be taken to recover the funds and cover any associated costs, including but not limited to bank fees, processing fees, and any legal expenses incurred.

11. Arbitration Agreement

Any disputes or claims arising out of or relating to this agreement, including disputes concerning the validity, interpretation, or performance of this agreement, will be resolved exclusively through binding arbitration. Arbitration will be conducted under the rules of the American Arbitration Association (AAA), and any hearings will be held in Las Vegas, Nevada. Both parties agree to waive any right to a trial by jury and agree that the arbitrator's decision shall be final and binding. Each party will be responsible for its own legal fees and costs, unless otherwise determined by the arbitrator.

12. Non-Disclosure and Non-Solicitation

The client agrees not to disclose any confidential or proprietary information shared during the course of the project to any third party without prior written consent from

editing.church . Additionally, the client agrees not to solicit any subcontractors or employees of editing.church for their own projects or other business engagements during the term of this agreement and for a period of 12 months thereafter.

13. Modifications

editing.church reserves the right to update or modify these terms and conditions at any time. Clients will be notified of any significant changes, and continued use of editing.church services after the effective date of any changes constitutes acceptance of those changes.

14. Acceptance of Terms

By engaging the services of editing.church, you acknowledge that you have read, understood, and agree to be bound by these terms and conditions.
